1. Acceptance of Terms

By creating an account, accessing, or using muse (the "Service") operated by BasedLabs (the "Operator", "we", "us"), you agree to these Terms of Service. If you do not agree, you may not use the Service.

2. Eligibility & Age Verification

The Service is intended exclusively for adults aged 18 years or older (or the age of majority in your jurisdiction, whichever is greater). By using the Service you represent and warrant that you meet this age requirement. We may use third-party age-estimation or verification tools and will retain successful verification results and associated metadata as described in our Privacy Policy. We disclaim all liability for any user who misrepresents their age.

3. AI-Generated Content; No Real Persons

All visual, textual, and audio content delivered through the Service is generated end-to-end by artificial intelligence. No human performers are recorded, captured, or depicted. Every character, persona, voice, and image is fictional and synthetic. Any resemblance to a real person, living or dead, is unintentional and coincidental. Personas have no sentience, agency, or real-world existence.

4. Acceptable Use

You agree not to use the Service to create, request, or distribute:

  • Content that sexualizes minors or persons appearing under 18 (zero tolerance — accounts will be terminated and reported to NCMEC).
  • Non-consensual intimate imagery (NCII) or deepfakes of real, identifiable persons.
  • Content depicting real individuals, including celebrities and public figures, in sexual or compromising contexts.
  • Content promoting violence, self-harm, terrorism, or illegal activity.
  • Content that infringes intellectual property or third-party rights.
  • Content prohibited by the laws of your jurisdiction or ours.

Violations may result in immediate suspension or termination without refund, and may be reported to law enforcement and relevant authorities.

5. Payments & Crypto Finality

Credits, time passes, and other paid features are purchased using cryptocurrency (e.g., USDC, ETH, BTC). Pricing is listed at checkout in USD with the cryptocurrency conversion calculated at transaction time.

Once a cryptocurrency payment is confirmed on the underlying blockchain, the corresponding credit grant is final and non-reversible. Cryptocurrency networks do not provide a chargeback mechanism. By initiating a cryptocurrency payment you acknowledge this finality.

Refunds: Where statute requires (e.g., 14-day EU/UK consumer withdrawal under Directive 2011/83/EU), users may request a partial refund prorated against unconsumed credits and unused time-pass days. Refunds are not available for: (a) credits or features already consumed; (b) accounts terminated for policy violation; (c) any portion of a purchase outside the statutory window in non-EU/UK jurisdictions. Refunds, when issued, are paid to the originating wallet address in the originating cryptocurrency.

Disputes: You agree to contact support@basedlabs.ai before initiating any payment dispute. Attempts to reverse confirmed on-chain payments via off-chain mechanisms (e.g., card chargebacks for crypto-on-ramp payments) may result in immediate account termination and ineligibility for future service.

6. License Grant

You retain ownership of the prompts and inputs you submit. By submitting inputs to the Service you grant the Operator a non-exclusive, royalty-free, transferable, sub-licensable, worldwide, perpetual license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and publicly display your inputs and the AI-generated outputs they produce, including for the purposes of operating, improving, and training the Service's underlying AI systems and for marketing and promotional uses.

The Operator grants you a personal, non-transferable license to use AI-generated outputs returned to you for lawful private purposes.

7. Moderation & Termination

We reserve the right to monitor, scan, manually review, and remove any content; suspend or terminate any account at any time without prior notice; and report illegal content and activity to law enforcement and regulatory authorities. No compensation is owed upon suspension or termination. Removed content may not be reinstated even if the underlying decision is later reversed.

8. Disclaimers; AS-IS

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OR RELIABILITY OF AI-GENERATED OUTPUTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE OPERATOR BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL; WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TO US IN THE 30 DAYS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$50.

10. Governing Law & Venue

These Terms are governed by the laws of [JURISDICTION TBD]. Any dispute shall be resolved in the courts of [VENUE TBD], and you consent to the exclusive jurisdiction of those courts. EU/UK consumers retain mandatory rights under local consumer-protection law that cannot be waived.
